✅ Terms and Conditions for Loqma Pro Platform

📌 Introduction
Before using the Loqma Pro Platform, please read the following Terms and Conditions carefully. By using the Platform, you agree to be bound by these Terms and Conditions.
This agreement (“Agreement”) constitutes a legal contract between you, as a user of the Loqma Pro Platform (the “User”), and the Loqma Pro Platform.
This Agreement includes all annexes and attachments referenced or appended hereto.
1. Definitions and Interpretation
Account: The account created by the User to access the Platform’s services.

Platform: The website, application, or any electronic interface provided by Loqma Pro.
Service: All digital functionalities and tools provided by Loqma Pro, including point of sale, order management, inventory, menus, and others.
User: Any natural or legal person who uses the Platform or its Services.
Information: All data and content provided by the User or generated through the use of the Platform.
2. Product Definition — Service Provided by Loqma Pro
The Platform includes multiple functions such as:

Loqma Pro is a smart electronic platform that provides integrated solutions for managing and operating food-related projects, such as restaurants, cafés, cloud kitchens, and food shops.
- Order and sales management.
- Point of Sale (POS) system.
- Inventory and purchasing management.
- Staff and task tracking system.
- Branch and user management.
- Building dynamic digital menus.
- Financial and analytical reports.
- Integration with delivery and payment services.
3. What does the subscription include?
- Account registration and use of the admin dashboard.
- Use of core tools for managing orders, menus, inventory, prices, and reports.
- Access to the POS system.
- Basic technical support within the scope of Platform usage.
- Ability to activate additional features depending on the selected plan.
4. What is not included in the subscription?

The basic subscription does not include certain services unless separately agreed, such as:
- Setup or data/content entry on behalf of the restaurant.
- Food photography or custom UI/UX design.
- Menu translation or preparing multilingual menus.
- Custom integrations with accounting systems or external delivery services.
- Hardware devices such as printers or order displays.
- Printing QR codes or supplying physical stands.
- Customized training for the team outside the digital Platform.
- Any additional services agreed upon for separate fees.
5. Account Creation and Use
- The User must create a project-specific Account pursuant to the registration procedures.
- Access to the Platform is granted via a username and password.
- Loqma Pro reserves the right to refuse or suspend any Account in case of violations.
- The User is responsible for maintaining the confidentiality of login credentials.
6. Items Displayed in the Menu
- All food items displayed in the menu through Loqma Pro must be halal and compliant with Islamic dietary rules for food and beverages. The Platform reserves the right to remove any item added if it does not meet these standards.
- In case of repeated addition of non-halal items, Loqma Pro reserves the right to suspend or delete the restaurant from the Platform without prior notice, in order to maintain the Platform’s commitment to providing options consistent with user standards.
7. Paid Subscriptions
- The Platform’s services are available under paid subscription plans based on duration (monthly, quarterly, annually).
- Subscriptions renew automatically unless cancelled by the User.
- The User may cancel the subscription through the dashboard or by contacting support.
- A limited free trial may be offered in accordance with the Platform’s policy.
8. Payment of Fees
- Subscription fees are paid in advance.
- The Platform may adjust prices or introduce new fees with notice to the User at least 30 days prior to application.
- Prices do not include VAT or payment gateway fees unless otherwise stated.
9. Information Usage Terms
- The User acknowledges that all information submitted via the Platform is accurate and up to date.
- The User grants the Platform a non-exclusive right to use menu content, images, and descriptions for the purposes of operating the Service.
- The Platform undertakes not to share any sensitive data (such as customer data or financial information) with any third party without the User’s consent, except in the following cases:
- An official request from a legal authority.
- Internal statistical analysis without revealing identity.
- Service improvement or Platform feature development.
10. Legal Liability
- Services are provided “as is” and “as available” without warranties.
- The Platform is not liable for direct or indirect damages arising from the use of the Service.
- The User is responsible for the accuracy of item data, prices, and content provided.
11. General Terms for End Users
- Loqma Pro is a digital platform for managing food businesses and is not responsible for food quality or delivery timing accuracy.
- Certain data is collected for analytical purposes and service enhancement, without external commercial use.
- The User may delete the Account or modify data at any time.
- The Platform is not liable for technical failures beyond its control.
12. Modifications and Updates
- The Platform reserves the right to update features and functionalities in line with market and technology developments.
- Plans, prices, and privileges may be modified, with prior notice to Users before implementation.
- Continued use of the Platform constitutes implicit acceptance of updates.
- The User may reject modifications by cancelling the subscription or contacting support.
- Governing Law and Dispute Resolution
- This Agreement is governed by the laws of the Sultanate of Oman.
- Disputes shall be resolved amicably; failing that, they shall be referred to the competent courts in the Sultanate of Oman.
